General terms and conditions of sale

These terms are accessible at all times on the Site and must be reviewed and accepted before any subscription.

Preamble

These General Terms and Conditions of Sale (hereinafter 'GTC') govern all contractual relationships between Elites Connect (a limited liability company under Tunisian law, hereinafter 'the Company') and any individual or legal entity (hereinafter 'the Member' or 'the User') subscribing to a membership or using the services offered via elitesconnect.com. By validating an order or creating an account, the User acknowledges having read, understood and accepted these GTC in their entirety without reservation.

Purpose of services

Elites Connect offers membership plans (Personal, Corporate, Privilege) granting access to a partner network offering exclusive discounts, benefits and experiences, as well as concierge services, private events and investment opportunities depending on the membership level. The Company acts as an intermediary facilitating access to its partners' offerings. It does not substitute for partners in the delivery of their services and assumes no responsibility for the quality, availability or performance of services provided by said partners.

Membership and activation

Membership becomes effective upon activation of the code provided after payment, upon completion of online payment, or upon validation by the Elites Connect team for Corporate and Privilege plans. The membership duration is that chosen at the time of subscription (1 month, 6 months or 12 months for the Personal card; individually agreed for Corporate and Privilege). Membership is personal and non-transferable. Any fraudulent use or breach of these GTC results in immediate termination without refund.

Pricing and payment terms

Applicable prices are those displayed on the Site at the time of subscription, expressed in Tunisian Dinars (DT) inclusive of all taxes. Payment may be made by cash, bank transfer or, when available, secure online payment. Payment is due in full at the time of subscription. For bank transfer payments, membership is activated upon actual receipt of funds. The Company reserves the right to modify its pricing at any time; changes do not affect already validated memberships.

Delivery terms

Elites Connect services are delivered digitally. The activation code is sent by email to the address provided at registration within a maximum of 48 business hours after payment confirmation. Access to services (partner network, concierge, events, private club) is available immediately after account activation. If the activation code is not received, the Member should contact customer service at contact@elitesconnect.com.

Cancellation policy and right of withdrawal

In accordance with Tunisian law, the User has a period of seven (7) calendar days from the activation of their membership to exercise their right of withdrawal, provided the service has not been used (no partner visits recorded, no benefits consumed). After this period, or upon first use of the service, no cancellation or refund shall be granted. The withdrawal request must be sent by email to contact@elitesconnect.com stating the full name, account email address and reason for cancellation.

Return, exchange and refund conditions

As the services are digital and intangible in nature, no returns or exchanges are possible. Refunds are granted only within the strict framework of the right of withdrawal mentioned above, less a flat fee of 15% of the membership amount for administrative processing costs. The refund shall be made within a maximum of thirty (30) business days from receipt of a valid request, using the same payment method used at subscription. In the event of termination by the Company for breach of the GTC by the User, no refund, even partial, shall be owed.

Renewal and termination

Membership is not automatically renewed. The Member will be notified by email before expiration and must proceed with voluntary renewal. The Company reserves the right to unilaterally terminate a Member's membership without notice in the event of conduct detrimental to the image of Elites Connect, breach of the GTC or fraud, without any compensation or refund being owed.

Liability

Elites Connect undertakes to use all reasonable means to ensure the availability and proper functioning of its services. However, the Company does not guarantee the absence of interruptions, errors or malfunctions and shall under no circumstances be held liable for indirect damages (data loss, loss of opportunity, commercial harm) resulting from the use or inability to use the services. The Company's liability is in any event limited to the membership amount actually paid by the Member for the current period.

Dispute resolution

In the event of a dispute relating to the performance or interpretation of these GTC, the parties undertake to seek an amicable resolution within thirty (30) days from the written notification of the dispute sent by email to contact@elitesconnect.com. Failing amicable resolution within this period, the dispute shall be submitted to the exclusive jurisdiction of the courts of Tunis, Republic of Tunisia.

Applicable law

These GTC are exclusively governed by and construed in accordance with Tunisian law. The parties expressly agree that any matter not covered by these GTC shall be resolved in accordance with the provisions of the Tunisian Code of Obligations and Contracts and the laws in force in the Republic of Tunisia.

Amendment of GTC

The Company reserves the right to amend these GTC at any time. Amendments take effect upon publication on the Site. Active Members will be notified by email of any material changes. Continued use of the services after amendment constitutes acceptance of the revised GTC.

Entire agreement

These GTC constitute the entire agreement between the Member and Elites Connect regarding the services offered. They supersede and replace any prior agreement, written or oral, relating to the same subject matter.
